MEMBERSHIP ELIGIBILITY REQUIREMENTS

LAWN & GARDEN MARKETING AND DISTRIBUTION ASSOCIATION
The following eligibility requirements are mandatory and shall be applied without exception. Such eligibility requirements shall constitute the minimum qualification for admission to and continuing membership in each of the listed membership classifications, and shall clarify and supplement the eligibility requirements for each membership classification appearing in the Association’s bylaws. Those corporations who specialize in the planning, promotion, and administration of conferences, trade shows, business events, and special functions are ineligible for membership in the LGMDA.

The determination of whether a particular member or applicant meets a particular requirement shall be made by the Board of Directors, and the Board’s determination shall be conclusive and binding. In the event that a particular applicant or member meets the membership eligibility requirements of more than one classification, the Board of Directors shall make a determination as to which classification the applicant or member bears the closest resemblance to, and the applicant or member shall, upon the Board’s determination to that effect, henceforth be a member of only that single classification.


1. Distributor Members Are Required To:

A. Be a seller of goods as a wholesale distributor providing sales, warehousing, delivery, and billing (extension of credit) services for Lawn & Garden Manufacturers.

B. Have the majority (greater than 50%) of the entity’s business in the provision of such services (as opposed to the selling of its own proprietary goods or acting as sales agents or manufacturers representatives).

2. Manufacturer Members Are Required To:

A. Be a seller of goods which are proprietary Lawn and Garden brands of the entity.
B. Have a minimum 25% ownership or financial interest in such brands.
C. Have such goods manufactured by the entity (prime) or, contract manufactured, assembled or packed for the entity either in or outside of the US.

D. The majority (greater than 50%) of the entity’s business in the selling of such goods.
3. Affiliate Members Are Required To:

A. Be sellers of goods and services inclusive of manufacturer representatives, sales agencies, importers, consultants, merchandising companies, trade organizations, contract manufacturers, etc.

B. Be such entities that do not otherwise meet the definitions of Manufacturer or Distributor as described above.

4. Emeritus Members Are Required To:

A. Be individuals.
B. No longer is active in the lawn and garden industry.

C. Have displayed active and significant participation in and contribution to the lawn and garden industry and, specifically, to the Association during their career.
